S4ET Terms of Use

 

S4ET and Acceptance of These Terms. This web application (“app”), S4ET, is intended to be used as a companion to Thinking Skills for Work, an online training and technical assistance program developed by the Center for Psychiatric Rehabilitation at Boston University (the “Center”). Any use of S4ET, including viewing or posting content, constitutes you acknowledgment and acceptance of these Terms of Use.

The Center reserves the right at any time to change the terms, conditions and notices under which the services of S4ET are offered, including but not limited to these Terms of Use, by posting such changes online. It is your responsibility to refer to and comply with these updated terms and conditions upon accessing S4ET. Your continued use after changes are posted constitutes your acceptance of any modified terms and conditions.

In addition, by using this app, you agree to comply with all applicable laws, including those prohibiting copyright and trademark infringement.

 

Your Use. In accessing S4ET, you agree to do so only for your own personal, educational or noncommercial use. Unless otherwise stated or agreed, you may not distribute, transmit, broadcast, or commercialize content. You agree not to use the app for any unlawful purposes or in violation of any law. You shall be solely responsible for your own submissions of content and for any consequences of posting or viewing content on this app. If you upload materials, such materials may be subject to copyright protections and other posted limitations on usage, reproduction and/or dissemination. You are responsible for honoring such copyrights and adhering to such limitations if you download the materials.

 

Review and Removal of Content. The Center reserves the right to take down any posting in response to report of abuse, as necessary to investigate alleged violations of University policies, federal, state, or local laws, or the rights of other persons, or otherwise at its discretion at any time and without notice or liability to you.

 

Copyright. All elements of S4ET, including without limitation, the text, software and graphics, are owned by or licensed to the Center, subject to copyright and other intellectual property rights under United States copyright and trademark laws, and applicable foreign laws. These elements may not be published, broadcast, or otherwise distributed without the prior written permission of the Center or Boston University. Boston University’s policy is to comply with the United States Copyright Act of 1976, as amended (17 U.S.C.) and to combat infringing use and to promote legal alternatives. Boston University maintains a vigorous program of accepting and responding to Digital Millennium Copyright Act (DMCA) notices of infringement through our registered copyright agent.

Trademarks and Links. The Center, S4ET, Boston University, and/or any other names of products or services provided by Boston University referenced herein are trademarks of Boston University. All other trademarks, service marks, and logos used in this app are the property of their respective owners. Links to other websites or apps do not imply an endorsement of the materials disseminated by publishers at those sites, nor does the existence of a link to another app imply that the organization or person publishing at that app endorses any of the materials at this app. The Center is not responsible for the materials contained at any website linked to this app.

 

Privacy. Any information collected through this app (such as your email address) will be subject to the Center’s Privacy Policy. The Center reserves the right to use your contact information as necessary, in the Center’s sole discretion, to send you information about the operation of the app. The Center may collect information automatically about the use of the app through “cookies” or similar technology. The Center may also archive log files and use non-personally identifying information in aggregate form to detect errors with the app, identify security issues, and build higher quality, more useful online services by performing statistical analyses of the collective characteristics and behavior of users, and measure demographics and interests in connection with specific areas of the app.

Please note that no organization can fully eliminate security or other risks associated with the possession of personal information. For example, third parties may unlawfully intercept or access transmissions or private communications. You are responsible for maintaining the confidentiality of your login information and password.

The Center may, at its discretion, disclose personal information to the police, regulatory bodies or any legal advisers in connection with any alleged criminal offense or suspected breach of these Terms of Use, including but not limited to, any claim of infringement by you, or otherwise where required by law.

 

Hold Harmless and Indemnification. You agree to hold harmless and indemnify Boston University, its trustees, employees, agents and representatives, from and against any third party claim arising from or in any way related to your use of S4ET, including any liability or expense arising from all losses, claims, damages, suits, judgments, costs and attorneys’ fees, of every kind and nature.

 

Disclaimer of Warranty. You acknowledges and agrees that S4ET is provided AS IS with all faults, and without any accompanying services or improvements from the Center or Boston University. The Center does not warrant that your use of this app will be uninterrupted or error free, that defects will be corrected or that this app is free of viruses or bugs. THE CENTER MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WHETHER RELATING IN ANY WAY TO THE CONDITION, QUALITY, UTILITY OR ANY OTHER MATTER REGARDING THE APP, YOUR USE THEREOF, OR OTHERWISE. THE CENTER MAKES NO REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, COMPATIBILITY, SECURITY OR NON-INFRINGEMENT.

 

Limitation of Liability. THE CENTER AND BOSTON UNIVERSITY SHALL HAVE NO LIABILITY FOR DAMAGES UNDER ANY FORM OF ACTION WHATSOEVER RELATED TO YOUR USE OF THE APP. THE CENTER SHALL HAVE NO LIABILITY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, WHETHER OR NOT INFORMED OF THE POSSIBILITY OF SAME AND WHETHER OR NOT OTHER AVAILABLE REMEDIES FAIL TO ACHIEVE THEIR ESSENTIAL PURPOSE.
